In case of a dispute as to the identity of a text message entrant, entry will be declared made by the Authorized Account Holder of the mobile telephone number. "Authorized Account Holder" is defined as the natural person who is assigned a mobile telephone number by the wireless carrier or as shown on the carrier's billing records. MAIL-IN METHOD OF ENTRY: To enter into the Sweepstakes without sending a text message, on a 3" x 5" card hand print your complete name, street address (no P.O. boxes), city, state, zip code, daytime telephone number with area code and/or cell phone number with area code, signature and date of birth and mail it in an envelope to: NWNA Circle K Sweepstakes P.O. Box 8019, Royal Oak, MI 48068. Mail-in entries must be handwritten. Photocopied or mechanically produced entries are not eligible for entry. Mail-in entries must be postmarked by 8/31/10 and received by 9/8/10. Mail-in entries will not be acknowledged. Limit one (1) entry per postmarked outer envelope.
The maximum number of entries per person for the Sweepstakes is ninety-two (92), regardless of method of entry. All entries become the exclusive property of Sponsor and will not be returned. Each person may only use one (1) mobile phone number to participate in this Sweepstakes, and such mobile phone number may only be used by one (1) person regardless of whether the mobile phone number is shared by two or more people. Any participant who uses more than one (1) mobile phone number to enter this Sweepstakes may be disqualified and any prizes won may be forfeited subject to Sponsor's sole discretion. By entering this Sweepstakes, entrants accept and agree to be bound by these full Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters.
PRIZES/ODDS: GRAND PRIZES (100): A total of one hundred (100) Grand Prize winners will each receive $1,000 worth of Circle K gift cards. (Approximate Retail Value "ARV" of each Grand Prize: $1,000). (ARV of all Grand Prizes: $100,000). Residents of California, Oregon, Utah and Washington will receive a $1,000 VISA gift card in lieu of Circle K gift cards. Limit one (1) prize per person. Gift cards are subject to the terms and conditions stated thereon. Prizes are nontransferable and no cash redemptions will be made. No substitutions permitted except at the sole discretion of Sponsor. Sponsor makes no warranty with respect to any prize or any part thereof. All taxes are sole responsibility of winners. Odds of winning depend on the number of valid entries received.
PRIZE DRAWING: Potential prizewinners will be selected in a random drawing on or about 9/15/10, from all eligible entries received from both text message and mail-in entries. The drawing will be conducted by an independent judging agency whose decisions are final. Fulfillment agent will attempt to notify each prizewinner by telephone within two (2) weeks of the drawing date. Each prizewinner will be contacted at the daytime number listed on his/her 3" x 5" card or at the mobile phone number listed if entered via text message method. If, after two (2) attempts, contact has not been made, prize will be forfeited and an alternate winner will be randomly selected. Fulfillment agent must reach potential winner; messages will not be left. Prizes will be delivered within 8-10 weeks of winner verification.

By entering this Sweepstakes, each winner consents to the use of his/her name, photograph, voice recording and likeness for publicity purposes by Sponsor without additional compensation or permission, where permitted by law.
LIMITATION OF LIABILITY: Neither Nestlé Waters North America Inc. ("Sponsor") nor Circle K is responsible for (i) lost, late, misdirected or incomplete entries, whether caused by entrant, printing errors, or by any of the equipment, or programming associated with or utilized in the Sweepstakes; (ii) printing or typographical errors in any Sweepstakes-related materials; and/or (iii) any computer, online, telephone, mail or technical malfunctions, delays or human errors that occur in the processing, transmission or receipt of entries, or for inaccurate transcription of entry information, or for entries that are stolen, misdirected, garbled, lost or delayed by computer/telephone transmissions or any injury or damage to persons or property, including, but not limited to, entrants' computers, phones, hardware and/or software, which may be caused directly or indirectly, in whole or in part, from entrants' participation in the Sweepstakes or receipt, redemption or use of any prize. If, for any reason, the Sweepstakes is not capable of being conducted as planned, including, but not limited to, infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of Sponsor, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes. RELEASE OF LIABILITY: All entrants by entering agree that (a) Sponsor and Circle K and each of their parents, affiliates, subsidiaries, and the officers, directors, agents, employees of each and all others associated with the development, administration, execution, fulfillment or advertising/promotion of this Sweepstakes are hereby released from any and all liability with respect to, or in any way arising from, this Sweepstakes and/or acceptance or use of any prize, including liability for personal injury, bodily injury, death, damages or loss; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs.
GOVERNING LAW : By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these full Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Connecticut, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Greenwich, CT.
